1. AGREEMENT.
These terms are a legal agreement between you and Kanatago AS ("the developer"), publisher of Hardcore Walk, for use of the app. These terms are concluded between you and the developer only, not with Apple Inc. ("Apple"). The developer, not Apple, is solely responsible for the app and its content. You accept these terms by selecting the agreement control in the app and continuing. Please read them before you agree. If you do not agree, do not use the app. Material changes require renewed acceptance before you continue using the shared world. Our Privacy Policy at https://hardcorewalk.com/privacy.html is incorporated by reference and explains how we process personal data. Accepting these terms does not replace any separate consent required for health data. The Apple-specific provisions below apply when you obtain the app from Apple.
2. LICENSE.
You get a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, as permitted by the terms of the store from which you obtained the app. For Apple devices, this license applies to Apple-branded products you own or control under the Apple Media Services Usage Rules, including access through Family Sharing or volume purchasing where applicable. You must comply with applicable third-party agreements when using the app, including your mobile service and app store terms. For Google Play downloads, use of the app is also subject to the Google Play Terms of Service. Google is not a party to this EULA. The developer is responsible for app support, warranties and claims; this EULA imposes no such obligations on Google. This does not limit rights or obligations under applicable law or Google Play's own terms, including applicable refund rights. You may not copy, modify, distribute, sell, rent, reverse-engineer, or attempt to extract the source code of the app except as permitted by law.
3. ACCOUNTS.
When you finish setup, the app creates a guest account unless you have already signed in. Your walker has an account identifier and display name; guest chat is not untraceable to the developer. You may link your account to Apple or Google sign-in to keep progress across devices. You can delete your account at any time in Settings; deletion is permanent. If you decline updated terms, account settings and our support/deletion request routes remain available. Do not evade a restriction by creating another account.
4. USER CONTENT AND CONDUCT (ZERO TOLERANCE).
Player names, round names, chat messages, drawings, reactions and other material you share through the app are user content. Chat is part of the shared walking game, including the road and virtual campsites. Proximity refers to progress in the game world, not your real-world location. Messages are visible to other players; do not treat proximity or campsite chat as a private conversation. You must accept these terms before contributing user content.
You keep ownership of your original content. You give us a non-exclusive, worldwide, royalty-free license to store, copy, render, resize and display it, and to let our service providers do so, only as needed to operate the features you choose and moderate the service. This does not give us a right to sell your artwork or use it in unrelated advertising. Shared drawings may be seen and saved by other players. If you opt into a public gallery, qualifying work can be shown beyond its original camp and kept in the gallery archive. Admission is not guaranteed by a purchase. You can withdraw gallery visibility; hiding work does not erase the archived copy. Account deletion removes the account link and replaces your displayed attribution, but does not automatically erase archived artwork. Contact support to request removal, including after account deletion. The Privacy Policy explains retention and your data rights. This license lasts only while the content is retained for these purposes and does not override your statutory rights.
There is zero tolerance for objectionable content or abusive behavior, including harassment, bullying, hate speech, slurs, threats, sexual content, child sexual abuse or exploitation, grooming, unlawful content, spam, scams, or impersonation. Do not share private information about yourself or anyone else, solicit personal contact details from children, or evade moderation. You are responsible for what you post and must have the right to share it. You must be at least 13 years old and meet any higher minimum digital-consent age applicable in your country to share user content.
We use automatic language filters for text and human review of shared drawings and reports. Filters cannot detect every harmful submission. Use Report on a message, or tap a walker and choose Report walker or Block walker. Blocking hides that walker's content from your view. You can also turn chat off in Settings. These chat controls apply to road and campsite chat. Drawings also have report controls, and blocking applies to shared drawings. Paying to share content does not exempt it from moderation or guarantee approval. You may report content or safety concerns to [email protected], including enough information to locate the content. Please do not include unnecessary sensitive information in your report.
We review reports promptly and take appropriate action against violating content and accounts. Threats and serious safety concerns receive priority. Actions may include removing content or suspending or banning an account. Content may also be hidden automatically after reports while awaiting review. A report does not automatically prove a violation. We may act immediately to protect players. We will explain restrictions and their reasons, subject to legal restrictions and the protection of other users. To appeal a moderation decision, email [email protected] with your account details and the decision you wish to appeal. A person will reconsider it and communicate the outcome.
5. HEALTH DISCLAIMER.
Hardcore Walk is a game, not a medical device, and does not diagnose, treat, cure or prevent any medical condition. It provides no medical advice. Step counts come from your device's health platform and may be inaccurate. Consult a physician before starting an exercise program. You use the app during physical activity at your own risk; stay aware of your surroundings.
The game includes flashing and flickering light effects. Flashing lights can trigger seizures in people with photosensitive epilepsy and cause discomfort in people sensitive to them. You can turn on Reduce flashing effects during setup or in Settings to turn off flickering light effects, sunrays and fireworks. This does not remove all moving images or changes in light and does not guarantee that the game will be suitable for you. Stop playing if you feel unwell. If you have a history of seizures or concerns about sensitivity to light, ask a healthcare professional before playing.
6. PURCHASES AND AVAILABILITY.
The app may offer optional paid digital items and features, including character models, other unlocks, and credits for an activity or for sharing content. The offer and store confirmation show the price, what you receive, and any limits or duration before you buy. Those details form part of your purchase agreement. You must have permission to use the payment method, including parental or guardian permission where required. Apple or Google processes payment under the applicable store terms. Current purchases are one-time purchases, not subscriptions. Any future recurring purchase would require a separate offer and your agreement to its billing, renewal and cancellation terms.
A non-consumable unlock can be used repeatedly without buying it again. Consumable credits are used up when the requested activity succeeds. Unused purchased credits do not expire. A credit buys the activity described in the offer, not indefinite display, storage, an audience or a particular response from other players. Shared content can be replaced after the minimum display period shown in the offer, or hidden or removed sooner at your request, for a refund, or under the moderation rules. Removal does not automatically return a spent credit, but does not limit any refund or other remedy required by law.
Purchases are linked to your app account and the purchasing store account. Link your guest account to a sign-in method to help keep access. Use Restore purchases with the purchasing store account for eligible non-consumable unlocks. Spent consumables cannot be restored as unused credits. Unused credits stay with the app account that bought them; restoring onto a different account does not transfer them. Store, platform and Family Sharing eligibility can vary. Contact support if an item is missing before buying it again. Deleting your account removes its unlocks and unused credits from our backend and does not itself request a refund from the store.
Digital items are licensed for personal use in the app, not sold as physical property or transferable assets. They cannot be traded, resold or exchanged for cash. This does not affect statutory refund rights. If a purchase is refunded, reversed or transferred through the store, the corresponding unlock or credit may be removed, and content obtained with that credit may be taken down.
For a refund, use the purchasing store's refund process or contact us at [email protected]. Store procedures do not limit claims you may make against us under applicable law. If you have a statutory withdrawal period for digital content, it is lost on immediate supply only when all legal requirements are met, including your prior express consent, acknowledgment of that loss and required confirmation. Accepting these terms alone does not waive it. Mandatory rights for missing, faulty or misdescribed digital content remain, including correction, price reduction, termination or refund where applicable.
We may update the service for security, legal compliance, technical needs or improvements. Changes to paid content must comply with applicable law and the purchase agreement. We provide required updates, information and notice, and any legally required right to end the agreement or receive a refund if a change or discontinuation affects your purchase. These terms do not allow us to remove paid access without any remedy required by law. Temporary interruptions may occur; contact support if they prevent you from using a purchase.
7. MAINTENANCE AND SUPPORT.
The developer, not Apple, is responsible for any maintenance and support of the app. Apple has no obligation to furnish maintenance or support. Support: [email protected] or https://hardcorewalk.com/support.html.
8. WARRANTY.
The app is provided "AS IS" without warranty of any kind, to the maximum extent permitted by law. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the developer's responsibility.
9. PRODUCT CLAIMS.
The developer, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including: (i) product liability claims; (ii) claims that the app fails to conform to legal or regulatory requirements; and (iii) claims under consumer protection, privacy, or similar legislation.
10. INTELLECTUAL PROPERTY.
In the event of a third-party claim that the app or your use of it infringes that third party's intellectual property rights, the developer, not Apple, is solely responsible for the investigation, defense, settlement and discharge of such claim.
11. LEGAL COMPLIANCE.
You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
12. THIRD-PARTY BENEFICIARY.
Apple and Apple's subsidiaries are third-party beneficiaries of these terms, and upon your acceptance, Apple has the right (and is deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
13. LIMITATION OF LIABILITY.
To the maximum extent permitted by law, the developer is not liable for indirect, incidental, special, consequential or punitive damages, or loss of data, arising from your use of the app. Total liability is limited to the amount you paid for the app and its in-app purchases in the last 12 months, except where liability cannot be limited by law.
14. TERMINATION.
These terms apply until terminated. We may suspend or terminate access for a serious or repeated breach, with notice and an opportunity to resolve it where appropriate or required by law. Immediate action may be needed to protect users or comply with law. You can appeal as described in section 4. On termination you must stop using the app. Termination does not remove accrued payment, refund or other statutory rights. Sections 4 to 13 survive only to the extent needed to give them effect.
15. GOVERNING LAW.
These terms are governed by the laws of Norway, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence remain unaffected.
